#SupremeCourt hears PIL alleging disparity in judicial decisions over demolition matters

Counsel for petitioner: on one hand, court recognizes right to shelter as part of right to live with dignity...but on the other, there are judgments holding that passage of time will not excuse even compoundable unauthorized structures. Authorities collect municipal tax, and then 30-40 years later, suddenly come to demolish. I seek appointment of a court-empowered committee

CJI Kant - there are already directions with regard to demolition

Justice Bagchi - You cannot substitute powers vested in a state to enforce rule of law. These are policy decision calls. We can step in if state's policy is arbitrary or not accommodating due process.
