A Division Bench of the Calcutta High Court comprising Justice Madhuresh Prasad and Justice Prasenjit Biswas held that the dismissal of a prior proceeding as infructuous due to a defective charge memo does not bar the disciplinary authority from issuing a fresh, proper charge memo as Order 23 Rule 1 CPC does not apply.

The Calcutta High Court on Thursday refused to grant interim relief to senior Trinamool Congress leader Sobhandeb Chattopadhyay in his challenge to the appointment of a rival faction leader, Ritabrata Banerjee, as the Leader of Opposition in the West Bengal Legislative Assembly, holding that no prima facie case had been made out for an injunction. The Calcutta High Court on Friday disposed of a petition challenging the West Bengal Government's notification calling upon government employees to participate in the International Yoga Day event to be led by Prime Minister Narendra Modi at Kolkata's Red Road, after the State clarified that participation was purely voluntary and that no coercive or punitive action would be taken against employees who chose not to attend.
