The Delhi High Court on Wednesday (November 26) issued notice on a plea filed by academic and writer Nitasha Kaul challenging the cancellation of her OCI card as well as prohibition on her travel to India.

Justice Sachin Datta sought response of the Union Government within four weeks and listed the matter for hearing on January 28, 2026.

Kaul has challenged the order passed on March 06 cancelling her OCI card and a “blacklisting order”, the details of which have not been disclosed to her, as per the petition.

It is her case that the content and legal basis on which the purported blacklisting order has been passed have neither been communicated to her nor tested on the touchstone of procedural safeguards mandated under Section 7D of theCitizenship Act, 1955.

Kaul is an academic of Indian origin, an international scholar and a holder of an OCI Card since 2010. The petition states that she has been “repeatedly targeted” for her critical academic writings and public engagement, without being provided with specific allegations or evidence warranting such actions.

“At the outset, it is submitted that both the Impugned OCI Cancellation Order and the “undisclosed” Purported Blacklisting Order are without any legal or factual basis, and no material has ever been supplied to the Petitioner herein on the basis of which such arbitrary actions have been taken by the Respondents herein,” the plea states.

Kaul is represented by Advocates Aadil Singh Boparai, Prakruthi Jain, Abhishek Dubey and Shruti Agrawal.
