The Delhi High Court on Thursday questioned the territorial jurisdiction of the suit filed by singer Jubin Nautiyal seeking protection of his personality rights.
At the outset, Justice Tushar Rao Gedela questioned the singer's lawyer as to why he did not approach the courts in Uttarakhand when he is based there.
“Why are you here? What is accessible here is accessible there. The courts there aren't abolished yet…,” the judge remarked.
As the counsel reasoned that the controlling authorities like MeITY and DoPT are in Delhi, the Court said that the reasoning was irrelevant.
“Merely because MeiTY and DoPT are here, jurisdiction is conferred here? What is the jurisdiction here? Tell us. Mr. Counsel, the jurisdiction has to come by virtue of what?… you are located in Uttarakhand,” the Court said.
“Your concern is infringement. Not implementation. They are only for compliances…. You don't have anything against them… Why Uttarakhand doesn't have jurisdiction?,” it added.
The Court then said that it will pass appropriate orders in the matter.
