A Bengaluru Court has granted an ex-parte temporary injunction against unknown persons restraining them from publishing or circulating any false or defamatory content against actor Yash starrer 'Toxic' movie scheduled for release on Friday.

The court of Additional City Civil and Sessions Judge passed the interim order in production company KVN Productions LLP's lawsuit against various defendants which also includes John Doe defendant. The court granted ex-parte temporary injunction till September 28, citing prima facie case and balance of convenience in favour of the plaintiff- producer.

“…On perusal of all the documents produced by the plaintiff, I found that there is a prima facie case in favor of the plaintiff, the balance of convenience lies in favor of plaintiff…If the TI is not granted, the very purpose of filing this suit will be defeated and it may amount to multiplicity of proceedings…Hence issue ex-parte temporary injunction order against the defendants from communicating, publishing, circulating, sharing, posting, streaming, providing access to or otherwise communicating in any kind of media anything false malicious, defamatory, derogatory, news concerning to film 'Toxic' either prior or after its release”.

The producer filed an application under Order 39 Rules 1 and 2 CPC seeking an ex-parte temporary injunction against defendants, including unknown persons.

The Court relied on the judgment of the Karnataka High Court in Meera Ajith v. John Doe @ Ashok Kumar, wherein the High Court ruled that an injunction could be granted against unknown persons 'if there is a genuine threat to the plaintiff and a prima facie case is made out”.

The interim order shall remain in force only till the next date of hearing on September 28.

“…This order cannot be used for any other purpose except for which it is granted”, the court clarified further.
