The Central Government will soon file a review petition against the recent SupremeCourt judgment in Pankaj Bansal v. Union of India which held that ED has to inform the grounds of arrest in writing and that mere non-cooperation to summons is not a ground to arrest.

Solicitor General of India Tushar Mehta made this submission before the Delhi High Court in the NewsClick case.

The Delhi High Court is hearing petitions filed by Prabir Purkayastha, Editor-in-Chief of NewsClick and Human Resources head Amit Chakraborty, challenging their arrests in the UAPA case over alleged Chinese funding. They have challenged the arrest contending that the grounds of arrest have not been communicated and relied on the Pankaj Bansal judgment.

In response, Solicitor General of India Tushar Mehta, for the Delhi Police, contended that the Pankaj Bansal judgment will not apply to the present arrest which happened on October 3 as the judgment clarifies that it will apply "henceforth" and was uploaded on October 4.
